JOB DESCRIPTION:
A diverse position requiring a strong litigation background combined with practical problem solving skills and an understanding of a business’ legal needs. Counsel, Litigation is responsible for managing and overseeing litigation matters and providing business-based, commercially viable legal advice to protect the organization’s interests within its risk profile. Works with CLO, other Legal Department attorneys and external counsel to set and execute litigation and dispute resolution strategies. Accountable for all internal litigation responsibilities. Provides actionable advice and counsel to CLO, senior management domestically and abroad, and other internal clients to limit risk exposure and minimize legal costs. The ideal candidate will have a proven track record of successfully managing complex litigation matters and providing practical legal advice and risk management guidance to business partners. Strong leadership, communication, and organizational skills are essential for this role.
- In depth management of all aspects of litigation, arbitration, and mediation, including strategy development, discovery, e-discovery, motion practice, depositions, settlement negotiations, and trial preparation.
- Work with members of the Engineering, Sales and Product Development teams on early resolution of potential disputes, warranty claims, and other matters requiring legal support.
- Work broadly across various business groups, operating companies, and departments to gather information and assess needs/capabilities to deliver tailored legal solutions.
- Review legal documents such as pleadings, motions, briefs, and settlement agreements, conducting legal research and analysis as necessary to support litigation efforts.
- Aid in the selection, retention, management and evaluation of outside counsel and experts, oversee the budgets and work of outside counsel on litigation matters.
- Advise management and business units on litigation risks and mitigation strategies.
- Ensure compliance with legal and regulatory requirements related to litigation.
- Develop and implement litigation policies and procedures.
- Manage litigation budget and expenses.
- Keep informed of industry-specific regulations and ensure that appropriate risk management strategies are in place.
- As a member of the Legal Department, assist internal business clients, CLO, and Legal Department staff with various tasks as assigned, including commercial / contract review.
REQUIREMENTS:
1. Juris Doctor degree from an ABA accredited school of law.
2. License to practice law in Commonwealth of Pennsylvania (or ability to obtain a Limited In-House Corporate Counsel License from the Commonwealth of Pennsylvania).
3. Minimum seven (7) years of litigation experience, preferably including both law firm and in-house experience.
4. Strong knowledge of civil procedure, evidence rules, and litigation best practices.
5. Experience handling discovery requests, document collection, and review.
6. Ability to manage multiple complex matters simultaneously.
7. Experience supervising support staff and with cost-effective management of outside counsel and legal budgets.
8. Ability to anticipate issues and estimate risks strategically; identify proactive solutions to eliminate or mitigate identified risks.
9. Excellent judgement and analytical skills; capable of developing trust and respect with key stakeholders through ‘first class’ interpersonal and communication skills.
