Telework

Job Summary

 

The Director, Construction Diversity Programs and Contract Compliance Management for MTA Construction and Development (MTAC&D), Diversity Compliance Team will be responsible for the compliance and diversity inclusion business initiatives for the MTA 2025-2029 Capital Program Plan that includes $68.4 billion dollar projects and pre-existing capital projects. The current portfolio of contracts consists of all Capital Projects from Bridges and Tunnels (TBTA), Long Island Railroad, Metro-North Railroad, New York City Transit and the former legacy Capital Construction Mega Expansion Projects. The person in this role will be charged with providing leadership, guidance, and responsible for promoting minorities, women, and veteran owned businesses diversity and inclusion in the MTA Capital Program managed procurements and contracts. The Diversity Team’s contract management includes a portfolio of 700 plus consolidated contracts and over 500 Projects, which includes East Side Access, LIRR 3rd Track, Penn Station Access, Penn Station Train Hall Renovation, Second Avenue Subway, and Stations.

The Director, Construction Diversity Programs and Contract Compliance Management will be responsible for ensuring MTAC&D procurement's compliance with adherence to contract terms and conditions, project execution by managing the Agency Contractor Evaluation (ACE) System as well as monitor and stay current with Federal Disadvantaged Business Enterprise (DBE) requirements, New York State Minority and Woman Business Enterprise (M/WBE), Service-Disabled Veteran Owned Businesses (SDVOB), Small Business Enterprise (SBE) procurement regulations to ensure compliance.

The incumbent will work closely with the MTAC&D Diversity Compliance Team, Contracts, Delivery Project CEO's, Project Managers, Owner Agencies, and the MTA Department of Diversity and Civil Rights (DDCR) with the development and implementation of the contractor, consultant, construction and supplier diversity strategic plans, initiatives and compliance reporting. The role is uniquely responsible for and shall incorporate effective diversity and inclusion practices into daily operations, culture, practices, processes and procedures with MTAC&D; and serve as a Champion at outreach events, forums, and other contracting vehicles to ensure MTAC&D continues to provide procurement and contract inclusion for diverse contractors, consultants and suppliers within the construction environment.

Responsibilities

Provide oversight, develop and foster success in the Capital Program - Construction

Contractor/Consultant/Supplier Diversity function at MTAC&D Contracts and Procurements to ensure alignment with the objectives, vision, and strategies of MTA Department of Diversity and Civil Rights (DDCR), New York State, FTA, and FRA objectives.

 

Conceptualize, implement, champion, and monitor initiatives to promote construction contract supplier diversity and the utilization of disadvantaged and small business enterprises, minority-owned and women-owned businesses, and service-disabled veteran owned businesses in MTAC&D managed contracts.

 

Oversee and review edits to scopes of work, technical specifications, project requirements and schedules in consultation with the Construction Contracts’ Team to ensure assembly of appropriate diversity and inclusion business terms and conditions within the capital projects procurements.

Drives MTAC&D Diversity Compliance Team and collaborates with Contracts’ procurement architect, engineering and other discretionary spending goals, including external outreach, internal communication, procurement of goods and services and compliance efforts.

 

Serve as MTAC&D Diversity Compliance Business Unit Lead between the Contracts’

Procurement Team, Project Management and CEOs, and MTA DDCR to ensure compliance with Federal, State and MTA requirements.

 

Participate and leads MTAC&D Diversity Compliance Team in outreach events to increase the pool of certified vendors to meet the needs of the Agency as well as achieve the NYS Governor’s MWBE Goal mandate of 30%, SDVOB Goal of 6%, and DBE Goal of 22%.

 

Serve as ACE Administrator and oversee the overall process and integrity of the system.

Monitor compliance and contractor/consultant performance while adhering to the contract

requirements for any recent and future awards.

 

Oversight of diversity compliance reports required by MTA Audit, MTA IG’s, and the MTA

Board. Coordinates with the General Counsel on any outside audits performed for

procurement or contract compliance. Facilitate and mediate prime and sub-contractor

disputes including payment issues, goal waiver request, retainage and close-out contract

matters.

 

Lead Diversity Compliance Representative at industry forums, meetings and conferences with government agencies and segments of private industry. Identify, cultivate and advance opportunities for D/M/WBEs, SDVOBs, SBEs while tracking, monitoring and reporting diversity activity for the MTAC&D Contract and Procurement staff.

 

Implement and formulate procurement procedures relating to construction/supplier diversity reporting, monitoring and compliance and other duties as assigned. Establishes the appropriate infrastructure to ensure key performance objectives are met. Administer learning evaluations and assessments to ensure targeted levels of program success.

 

Process prime and subcontractor background checks for new awards and contracts

modifications to ensure no Significant Adverse Information (SAI) for the vendor prior to

start work on any MTA project, as needed, and serve as the Vendor Relations Unit (VRU) liaison.

 

 

Education and Experience

 

Bachelor’s degree in Public Administration, Finance, Business Administration or related field.

 

Must have a minimum of ten (10) experience in similar position within a minority, women or small business enterprise program and diversity business initiatives, contract or public administration related to the solicitation, administration of procurements, construction and compliance reporting, or comparable environment.

 

Must have a minimum of five (5) years of working in construction supplier diversity, procurement, and contract management environment.

 

Competencies:

 

Knowledge of MTA objectives and operations. Extensive knowledge of Diversity Compliance, MWBE, SDVOB, Small Business Enterprise, State and Federal regulations.

 

Proven leader with experience in leading transformational change within a large organization is preferred.

 

Proven ability as a comprehensive, integrative thinker with thorough knowledge of the

business and ability to build strong partnerships with staff and stakeholders.
