What you will do:
The Litigation Counsel is responsible for providing a wide range of in-house legal services for eXp Realty, LLC. Primary areas of focus include: managing litigation, including conferring with outside counsel, developing litigation strategy, determining settlement value, facilitating outside counsel in responding to discovery requests, providing advice concerning legal issues that arise during real estate transactions, analyzing and responding to or drafting demand letters, cease and desist letters, and other similar correspondence, facilitating compliance with regulatory requirements, responding to or assisting in the response to regulatory complaints, and assisting with compliance and training as needed. 

 

This role requires a strategic thinker with strong attention to detail and experience collaborating with clients in a fast paced environment of innovation. A qualified candidate must be able to operate with a high case volume and successfully shift attention between lower value and higher value matters. Due to the fully remote nature of work at eXp, an affable, team-oriented personality is a must.
  • Performance driven management and accountability of assigned litigation matters for the company with the ability to work collaboratively, manage independently and overcome obstacles to produce results in a timely fashion.
  • Judge the merits of claims and court cases filed against or on behalf of the company, work with the appropriate business partner(s) to develop a strategic defense, and recommend approval of  settlements where warranted.
  • Oversee the selection, retention, management, and evaluation of outside counsel.
  • Develop and maintain strong business relationships as a key relationship manager for the legal department among the various internal business groups requiring litigation support.
  • Demonstrate team working skills in support of a collaborative environment.
  • Draft legal documents as needed.
  • Prepare responses to complaints/claims filed with federal, state, and/or municipal agencies or courts, as well as third-party organizations.
  • Perform legal research, analyze, organize, and strategize effectively.
  • Exercise discretion and independent judgment commensurate with specialized legal skills and experience.
  • Create and maintain a work environment that promotes client service, teamwork, performance feedback, recognition, mutual respect, and employee satisfaction that encompass the company’s core values.
  • Other Accountabilities as Assigned
Education & Experience:
  • Juris Doctorate from a law school accredited by the American Bar Association
  • Admission to at least one state bar and currently in good standing
  • 2+ years experience in a law firm environment as a practicing litigation lawyer, preferably with a regional or national law firm before moving to an in-house position.
  • Experience managing a high caseload with competing priorities
  • In-court experience, including arguing motions, small claims or regular civil trials, and representing clients in mediation.
  • Prior experience in real property law, including residential real estate transactions, business law, agency law, or contract law preferred.
  • Experience with cost-effective management of outside legal resources preferred.
  • Prior experience advising clients on options in litigation and providing recommendations based on the client’s goals and cost.
  • Strong teamwork and communication skills – written and verbal - to work with stakeholders across various geographies and functions; comfortable in business and technical discussions.
  • Ability to make recommendations regarding best practices.
  • Experience drafting and revising legal documents.
  • Ability to manage competing priorities.
  • Strong analytical skills to work on complex business issues with minimum supervision.
  • Ability to adapt quickly and learn new tasks independently.
  • Results driven with the ability to meet deadlines.
  • Computer skills in Google and Microsoft products. Familiarity with Trello is a plus. Overall comfortability with technological resources is a must.
  • Ability to influence, negotiate, and hold teams accountable to execute.
  • Ability to work independently and in ambiguous situations.
