Job Summary - a concise overview of the job

The Commercial Counsel possesses strong legal and business acumen and works cross-functionally within the organization to help execute Endo’s business strategy in compliance with applicable laws, regulations, and policies. This person is responsible for handling and advising a variety of legal, regulatory, and compliance considerations and issues, principally related to the sale and marketing of pharmaceutical products. The Commercial Counsel may also be assigned to provide legal support to various other departments and projects.

All incumbents are responsible for following applicable Division & Company policies and procedures.

Scope of Authority - span of control (work unit, site, department, division, etc.), monetary value of budget/spend authority ( capital, operating, etc.), P&L responsibility, etc.

Endo Pharmaceuticals Inc. and subsidiaries, and when requested PLC corporate-wide counsel and initiatives.

Legal Support

Provide legal support and clear legal advice to various departments, including Sales and Marketing, Regulatory, Communications, Medical Affairs, and Compliance, on a variety of legal, regulatory, and compliance issues.

Review of Promotional Materials

Provide legal review and guidance on materials used in promotion, sales training, and/or non-promotional initiatives.

Contracts Review and Support

Support business units in connection with agreement preparation and negotiation; help develop templates as required and provide legal advice on contracts matters and disputes.

Special Projects and Initiatives

Support senior members of the Legal department on other matters and initiatives.

Policy Development and Training

Provides legal advice and assistance for the development of policies and training.

Qualifications

Education & Experience

Minimal acceptable level of education, work experience and  certifications required for the job

§  Law degree from an accredited institution and active state bar member.

§  Minimum of 4 years of relevant experience.

§  Meaningful experience in drafting contracts and advising on business matters.

§  Pharmaceutical/life sciences industry experience is preferred.


Knowledge

Proficiency in a body of information required for the job    

e.g. knowledge of FDA regulations, GMP/GLP/GCP, Lean Manufacturing, Six-Sigma, etc.

§  Knowledge of FDA regulations, FTC, FCA, AKS, and other pertinent regulations and guidance.

§  General contract/corporate law knowledge.

§  Strong legal knowledge of the laws, regulations, and guidance governing the sale and promotion of pharmaceutical products.

Physical Requirements

Physical & mental requirements     e.g. lift 40 pounds, walk across plant/warehouse, business travel (% of time), driving as part of work responsibilities, etc.

§  Business travel is typically up to 10% of the time; may exceed 10% as business needs dictate.
