Position Title:Contract Manager

Position Summary:

 

E-Storage is seeking an experienced contract manager to join its in-house legal team and support the rapidly growing utility-scale energy storage business unit. The Contract Manager will report in solid line to the Associate General Counsel and on a dotted line to the Managing Director, Operations and Service and will work closely with the legal and project implementation teams. The Contract Manager will provide commercial, risk management and contractual support to the legal and the project implementation teams for all contract management and administration activities primarily during the implementation, construction and operations and maintenance phases of a project.

 

 

Primary Responsibilities:

 

  • Thorough review, identification and tracking of key commercial and technical risk factors and obligations due under equipment supply; engineering, procurement and construction; and long-term service contracts, including payment security, HSE, product compliance, insurance, license regulations and other contractual deliverables
  • Assist project managers with the interpretation and administration of contracts including drafting and delivery of project correspondence, notifications and certificates
  • Monitors, tracks and prepares contract change orders and other amendments through coordination with relevant departments
  • Proactively manage claims to/from customers and partners
  • Provide guidance and sometimes leads the negotiation and settlement of project issues, changes, delay liquid damages settlements, etc.
  • Management of claims to/from contractors, subcontractors and suppliers as required and ensure appropriate recovery from third parties.
  • Manage Project variation requests/orders
  • Manage Project insurances: ensure contract compliant insurance coverage; submit, monitor and settle of insurance claims in accordance with the policies
  • If requested, provide support and guidance and training to the Project team on general contractual issues. Clarify contractual/legal enquiries, if necessary, referring to Legal
  • Provide support in the event of dispute
  • Report on Project claims and variations, as well as potentially critical contract issues to management and, as required, to project control, finance and audit staff
  • Report to management for the approval of variation orders, amendments and settlements in accordance with the applicable Delegation of Authority
  • Support the Services Director in the management and implementation of the Long-Term Services Agreements, including the preparation of performance guarantee liquidated damage claims and correspondence

 

Qualifications & Requirements:

 

  • University degree in either engineering, quantity surveying, business administration or law
  • 7+ years experience in contract management, preferably in engineering, infrastructure and construction contracting in the energy industry
  • Proven experience / track record in claim preparation, evaluation and settlement negotiation (extension of time claims, delay liquidated damages, force majeure, contract renegotiations, etc.)
  • Experience evaluating claims and developing claims strategy.
  • Knowledge of delay analysis principles (critical path analysis, concurrent delay principles etc.)
  • In depth understanding of legal terminology and concepts used in commercial construction contracts
  • Knowledgeable in contract law principles
  • Understanding of project risk management
  • Experience in direct counter-party negotiations, including persuasive written and verbal skills
  • Extensive and demonstrated experience of hands-on contract management experience in complex infrastructure projects (power generation and power transmission preferred)
  • Exceptional communication skills with internal and external stakeholders
  • Capacity to prioritize work and interface with relevant stakeholders for the collection of information
