Junior Legal Counsel
The Bermuda Monetary Authority (Authority or BMA) is seeking the services of a skilled and capable team member to work as Junior Legal Counsel within our Legal Services and Enforcement Department. Reporting to the Assistant Director, Legal Services and Enforcement, the incumbent will perform various duties, including applying advanced analytical skills to provide legal interpretations of laws, rules, and regulations, drafting legal documents, and representing the Authority in hearings/appeals and mediations, as necessary.
This is a key role for the Authority and the incumbent will be responsible for, but not limited to:
• Planning for and participating in various tasks by evaluating moderate-to-highly complex information and variable issues with substantial impact, weighing various alternatives and balancing potentially conflicting situations using multiple sources of information
• Conducting witness interviews, taking statements and documenting all case-related activity, including people contacted, documents and data reviewed, etc. and developing enforcement cases
• Drafting and finalising, with increased independence, statements and other legal documents, including pleadings, affidavits and other similar documents
• Establishing and maintaining effective relationships and communications with supervisory units, internal subject matter experts, law enforcement and other agencies, as well as Senior Management
• Participating in meetings with supervisory units and regulated entities as required
• Conducting legal and regulatory research as directed
• Participating in all aspects of enforcement and regulatory processes, as directed
• Undertaking annual legal training as part of ongoing professional development to ensure training remains current with legislative changes, best practices, and emerging issues relevant to the Authority’s work, thereby maintaining the highest standards of legal expertise and compliance. Performing other related work and special projects as assigned in accordance with competencies normally associated with the post
This position requires a proven technical and business background. Therefore, the incumbent should have:
• An accredited law degree and be a Barrister or Solicitor admitted to practice in Bermuda
• A minimum of three (3) years’ relevant legal experience in a regulatory environment or commercial law, or financial services law, gained through private practice or employed in a financial services industry with a financial services authority
• A working knowledge of Bermuda’s insolvency and restructuring law, administrative law and financial services law
• Strong analytical, interpersonal and communication skills (both written and oral), research capabilities, resourcefulness and creative abilities
• The ability to interface effectively with the financial services industry, government and various international regulatory bodies
