The Role

 

Manages the ongoing development and implementation of EEO/Affirmative Action Program strategies through policies, programs, training and other initiatives. Interacts with internal and external stakeholders at various levels within organizations.  Concurs in the hiring and promotion practices.  Stay abreast of developments in EEO legislation and OFCCP (Office of Federal Contract Compliance Programs) regulations, which may affect strategies and actions to ensure Agency compliance.  Comply with the requirements established by FTA Circular UMTA C 4704.1 (Equal Employment Opportunity Program Guidelines for Grant Recipients) and applicable laws, regulations and Agency Policies. 

Responsibilities

  • Manage and investigate internal employment complaints (Title VII) of discrimination, harassment, hostile work environment and/or retaliation.
  • Manage charges referred from Governmental Compliance Agencies including mediation, settlement negotiations, and legal proceedings.
  • Design and implement audit and reporting systems for tracking of all complaints.
  • Manage and investigate customer service (Title VI) complaints regarding discrimination in public accommodations.
  • Plan and organize affirmative action work programs; establish and monitor controls to evaluate department performance; take appropriate action to correct performance and to adjust program initiatives to meet requirements.
  • Maintain contact with equal opportunity compliance agencies regarding complaints of discrimination, harassment, hostile work environment and retaliation while attempting conciliation.
  • Conduct training programs in areas associated with equal employment opportunity; serve as liaison between Agency management, minority organizations and community action groups concerned with employment opportunities for minorities, females, individuals with disabilities and veterans.
  • Conduct training programs for Agency personnel in the areas of discrimination, harassment, hostile work environment and retaliation prevention, sexual harassment prevention, and other EEO matters.
  • Meet with Talent Management and/or HR monthly, to discuss EEO program trends.
  • Establish effective communications with all levels of management, supervisors and staff to communicate EEO Program goals and trends.
  • Plan, direct, control the development, monitoring and reporting of all aspects of the Agency Affirmative Action Plans.  Collect statistical data, analysis data and translate into easily understandable reports and recommendations.
  • Plan and use resources economically; prepare and manage an accurate budget, monitor expenditures; and safeguard their use; procure, store and distribute material economically and efficiently; ensure efficient maintenance and operation of facilities and equipment to meet the needs of users.
  • Prepare and approve reports; direct and perform collection, organization, analysis and evaluation of data and information; develop and present conclusions and recommendations.
  • Communicate understanding and support of organizational goals through actions and spoken and written words; interact effectively with individuals and groups at all levels; maintain ties with external organizations; keep all interested and involved parties informed of matters requiring their attention.
  • Ensure compliance with all applicable policies, rules regulations and laws; stay abreast of legal, regulatory and policy developments affecting areas of responsibility; enforce legal and regulatory requirements impartially.
  • Designing, implementing, and monitoring internal audit and reporting systems to measure EEO Program effectiveness and to determine KPI and where proactive action is required.
  • Act as liaison with executive leadership regarding the Agency’s implementation of the EEO Program, including development of EEO policy statement as well as other EEO policies and procedures.
  • Reporting at least quarterly to the CEO/GM on progress in relation to the agency’s goals and compliance with the EEO Program.
  • Disseminate EEO laws and regulations to responsible officials, ensuring laws and regulations affecting nondiscrimination are current and posted for viewing as required
  • Develop concurrence procedures for FTA audits.
  • Collaborate with HR on the hiring and promotion process.
  • Participates in the compilation of periodic reports of the Agency's workforce by collecting, compiling and analyzing data pertinent to EEO in compliance with Federal, State and local laws. 
  • Apply Federal, State and local laws, regulations and guidelines pertaining to equal employment opportunity.
  • Availability to work varying schedules including nights and weekends as necessary.
  • Availability to travel locally to various Agency facilities.
  • This position requires completion of Federal EEO Investigator training certification within 30 days of hire.

Knowledge, Skills, & Abilities

Meet with Agency management officials to develop and implement the Equal Employment Opportunity (EEO) program. Meet with representatives of equal opportunity regulatory agencies to discuss problems and to represent agency interests. Meet with representatives of law firms to provide and receive information relative to cases of alleged discrimination. Advise Agency managerial and supervisory employees regarding potential complaints of discrimination.  Solid understanding of federal, state and local equal opportunity laws and regulations and of personnel management principles and practices. Ability to learn Agency policies, procedures and operations. Must be able to establish policies and procedures, evaluate program effectiveness, supervise, and evaluate the work of employees. Ability to communicate effectively, both orally and in writing. Interact effectively with agency management officials, and staff, as well as representatives from equal opportunity regulatory agencies. Ability to prepare, justify and administer a budget. Must be able to communicate and perform within a multi-national, multi-ethnic organization. Works independently, resolves and consults on complex issues, possess strong verbal and written communication skills.

 

Education

Experience

Degree: Bachelor’s Degree is required, Master’s Degree preferred.

Years: Five (5) years of experience in EEO, Human Resource, and Affirmative Action is required.

Field: Human Resources, Social Science, or a related field.
