Deputy General Counsel, Commercial

Position Summary:

The Deputy General Counsel, Commercial is a key member of our legal team who will primarily support the commercial function.


  • Provide strategic legal and business insight on the global launch of our product candidates
  • Review and advise on programs, initiatives, and contracts related to sales, marketing reimbursement, market access, and non-promotional education
  • Review and advise on promotional materials, sales training materials, federal and state government price reports, and corporate communications
  • Review and advise on interactions with patients, physicians, payors, regulatory agencies and government reimbursement programs
  • Serve as the company’s subject matter expert in the areas of healthcare law and all applicable pharmaceutical marketing, drug pricing and reimbursement, anti-kickback, privacy, fraud and abuse, anti-bribery, Sunshine Act and product liability statutes and regulations
  • Identify training needs within the organization and develop and present training sessions on relevant laws and legal/business issues
  • Stay abreast of and communicate to the organization all significant pending and actual decisions, legislation and regulatory rulings that may affect the company in the area of commercial healthcare law
  • Establish a rapport and a positive working relationship with management and personnel at all levels, particularly within the home office and field-based commercial organization, to encourage and continue the proactive use of in-house legal counsel
  • Other duties as assigned

Education, Registration & Certification:

  • J.D. from a law school accredited by the American Bar Association (ABA)
  • Admitted to practice law in one or more states


  • At least 10 years of related experience within a commercial stage pharmaceutical or biotech company or law firm equivalent
  • Large law firm experience helpful
  • Expertise in the areas of corporate commercial healthcare, and FDA regulatory law and regulation, including with respect to FDA labeling and promotional matters, healthcare fraud and abuse laws, pricing and reimbursement issues, U.S. and international transparency laws and regulations, privacy laws, anti-bribery laws, and other laws and regulations related to the development and commercialization of pharmaceutical products

Physical Demands and Work Environment:

This is largely a sedentary role; however, some filing is required. This would require the ability to lift files, open filing cabinets and bend or stand on a stool as necessary.

This job operates in a professional office environment and routinely uses standard office equipment such as computers, phones, photocopiers, filing cabinets and fax machines.
